The Essence
Every employee in Israel is entitled to paid annual leave. The number of leave days depends on your seniority (vetek). Upon termination of employment or change of job, all unused leave days must be paid to you as monetary compensation ('pidyon chufsha').
Who is Entitled?
- All employees in Israel, including hourly workers, from the first day of employment.
- The right extends to both citizens and foreign workers with a work visa.
- The number of accrued days depends on the length of service with a specific employer and the work week format (5 or 6 days).
Who is NOT Entitled?
- Independent contractors (atzma'im), unless otherwise specified in their contract.
- Employees who were absent from work without pay for more than 200 days in a year (in which case the calculation is made proportionally).
Your Rights
The primary right is to receive paid days off for rest. If you have not used all of your entitled days, you have the right to monetary compensation for them upon termination of employment.
Accrual of Leave Days (for a 5-day work week):
| Years of Service with Employer | Number of Leave Days per Year |
|---|---|
| Years 1-5 | 16 days |
| 6th Year | 18 days |
| 7th Year | 21 days |
| 8th Year and onwards | 21 days + 1 day for every 2 years (max. 28) |
Compensation upon Termination ('Pidyon Chufsha'): Upon termination of the employment relationship, the employer is obligated to pay the monetary equivalent of all accrued but unused leave days. The calculation is based on your last daily rate of pay.
Step-by-Step Guide
How to Take Leave:
- Check Your Balance: Review the number of accrued days on your latest payslip (
tlush maskoret). - Coordinate Dates: Discuss and agree upon the desired leave dates with your direct supervisor. By law, the employer has the right to determine the leave schedule but must act in good faith and consider your preferences.
- Submit a Request: If your company has a formal procedure, submit a written or electronic leave request.
How to Receive Compensation upon Termination:
- Automatic Calculation: Compensation for unused leave should be automatically included in your final settlement (
gmar heshbon). - Review the Final Settlement: Carefully examine the final
tlush maskoretand thegmar heshbondocument to ensure the payment has been made and calculated correctly. - Send a Demand: If payment has not been made, send a written demand to the employer (registered mail is recommended) with the calculation and a request to settle the debt.
- Legal Action: If the employer ignores your demand, the next step is to file a claim with the Labor Court (
Beit Din le-Avoda).
List of Documents
To monitor and prove your rights, always keep the following documents:
- Payslips (
Tlushei maskoret) for the entire period of employment. - Employment contract (
Hoze avoda). - Letter of termination or resignation (
Michtav piturin / hitpatrut). - Final settlement document (
Gmar heshbon), if provided. - Any correspondence with the employer regarding leave or termination.
Pitfalls
- Statute of Limitations: A claim for compensation for unused leave can only be made for the last 3 full years of employment plus the days accrued in the current year. Any days accrued prior to this period are forfeited.
- Carry-over of Days: By law, you are required to use at least 7 leave days per year. The remaining days can be carried over to the next two years. The employer cannot prohibit this carry-over if you have used your mandatory 7 days.
- Prohibition of In-Lieu Payments During Employment: The employer is prohibited from paying you money in lieu of providing leave while you are still employed. Compensation is only possible upon termination.
- Sickness During Leave: If you fall ill during your leave and have a medical certificate, these days are considered sick days, not leave days, and your leave balance must be restored.
- Mandatory Leave: An employer can require you to take leave but must provide advance notice (14 days for leave lasting 7 days or more).
